By creating an account, logging in, or using the NIYOJAN platform at niyojan.live or any associated application, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not create an account and do not use the platform.
These Terms constitute a legally binding agreement between you and Nitish N Daftari, trading as NIYOJAN, based in Pune, Maharashtra, India.
If you are agreeing on behalf of a company, you represent and warrant that you have the authority to bind that company to these Terms. In these Terms, "you" refers to both the individual user and the company on whose behalf they act.
NIYOJAN is a software-as-a-service platform that:
The NIYOJAN observer number is strictly read-only. It does not send messages, reply to any message, react to any message, add or remove group members, or interact with your WhatsApp groups in any way other than passively reading messages.
You will inform all members of any WhatsApp group that you link to NIYOJAN that an AI-powered tool is reading and processing messages in that group. You will do this before or immediately after adding the NIYOJAN observer number to the group. NIYOJAN provides a standard notification message for this purpose in the Groups section of your admin panel. Failure to inform group members is entirely your responsibility and liability. NIYOJAN accepts no liability for any claim arising from a group participant who was not informed.
You will only link WhatsApp groups used for legitimate professional business operations — event coordination, vendor management, client communication, or team operations related to your event planning business. You will not link personal family chats, personal conversations between friends, or any group not directly related to your professional event coordination activities.
You will provide accurate and truthful information about your company name, your name, your contact details, and your team during onboarding and at all times during your use of the platform.
You will only grant dashboard access to employees and contractors of your company who require access for legitimate operational purposes. You will not share login credentials between users. Each team member must have their own login.
You will not use NIYOJAN to monitor personal conversations, surveil individual employees without their knowledge in a manner contrary to Indian labour law, gather intelligence on competitors, or use the platform for any purpose other than legitimate business event coordination.
You are responsible for ensuring that your use of NIYOJAN — including which groups you link and who has access to the dashboard — complies with the Digital Personal Data Protection Act 2023, the Information Technology Act 2000, and any other applicable Indian law.
You own your data. NIYOJAN does not claim ownership over your WhatsApp messages, your extracted tasks, your vendor payment records, or any other operational data generated through your use of the platform.
You grant NIYOJAN a limited, non-exclusive, non-transferable licence to process, store, and display your data solely for the purpose of providing the platform services described in these Terms. This licence ends when you close your account, subject to the retention periods described in our Privacy Policy.
NIYOJAN may use anonymised, aggregated, non-identifiable statistics — such as average number of tasks extracted per event — for internal product improvement and business reporting. We will never use your identifiable data, your company name, your team members' names, or any specific event data for this purpose.
You may not use NIYOJAN for any of the following:
Violation of any of these prohibitions may result in immediate account suspension or termination without refund. Depending on the severity of the violation, NIYOJAN reserves the right to report the violation to appropriate authorities.
NIYOJAN uses AI to extract operational data from natural language messages. AI extraction is probabilistic and will sometimes produce incorrect results — missing items, misclassifying messages, or extracting inaccurate data.
NIYOJAN is a decision-support tool. It is not a replacement for human judgment, direct team communication, or professional operational management. You must independently verify all critical operational decisions, financial commitments, and vendor arrangements through direct communication with the relevant parties.
NIYOJAN makes no warranty regarding the accuracy, completeness, or fitness for purpose of any AI-extracted data. You use AI-extracted data at your own risk and judgment.
NIYOJAN is currently in an alpha stage of development. During this stage, we do not guarantee any specific level of uptime, service availability, or continuity. The platform may be unavailable for maintenance, updates, or unforeseen technical issues without advance notice. No service level agreement (SLA) is in effect during the alpha stage.
We will make reasonable efforts to maintain service availability and will communicate planned maintenance through email and in-app notification where possible.
NIYOJAN's core functionality depends on the WhatsApp platform, which is operated by Meta Platforms, Inc. NIYOJAN has no control over WhatsApp's terms of service, technical capabilities, or enforcement decisions.
In the event that WhatsApp restricts, suspends, or bans the NIYOJAN observer number, we will notify affected companies within 24 hours of discovery and service will be unavailable for those companies until the issue is resolved. No refund or credit is owed for disruptions caused by WhatsApp platform changes, enforcement actions, or technical failures outside NIYOJAN's control.
You acknowledge and accept this platform dependency risk by using NIYOJAN.
Current pricing plans and fees are published at niyojan.live/pricing. Pricing terms are as displayed on that page at the time of purchase, or as agreed in your separate subscription discussion with NIYOJAN.
During any free pilot or trial period, all terms in this Agreement apply in full. Free access does not reduce or waive any of your responsibilities under these Terms.
You may close your account at any time by contacting privacy@niyojan.live. We will acknowledge your request within 72 hours and complete account closure and data deletion within 30 days.
NIYOJAN may suspend or terminate your account with immediate effect if:
If NIYOJAN discontinues the service entirely, we will provide a minimum of 30 days advance notice by email and will provide you with a full export of your data before the service ends.
To the maximum extent permitted under Indian law, NIYOJAN's total liability to you for any claim arising out of or related to your use of the platform — whether in contract, tort, or otherwise — is limited to the total amount you paid NIYOJAN in the three months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Nitish N Daftari, trading as NIYOJAN, from and against any claim, liability, loss, damage, or expense — including reasonable legal fees — arising out of or related to:
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of NIYOJAN shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
Before initiating any legal proceeding, you agree to first attempt to resolve the dispute by contacting privacy@niyojan.live and providing NIYOJAN 30 days to respond and attempt good-faith resolution.
We will notify you of any material changes to these Terms by email and by in-app notification at least 14 days before the changes take effect. If you continue to use the platform after the effective date, you are deemed to have accepted the updated Terms. If you do not accept the updated Terms, you may close your account within that 14-day window and receive a prorated refund of any prepaid subscription fees.
